Why GDPR matters when building with AI
AI opens up powerful new ways to automate, predict, and personalize — but if your product touches personal data and your users are in the EU (or you are), you need to think carefully about GDPR compliance from day one.

1. Understand what counts as “Personal Data” in AI contexts
GDPR defines personal data broadly — not just names and emails, but also:
Chat messages

Tip: If your AI copilot, chatbot, or automation tool processes this type of data — even temporarily — you’re subject to GDPR.
2. Choose the right AI infrastructure
Using OpenAI, Claude, or other LLM APIs? You’ll need to ask:
Where is data stored or processed?
Is it used for model training?
Can we opt out of data retention?
For GDPR compliance, look for providers that offer:
EU-based or region-selectable hosting
Clear data processing agreements (DPAs)
Options to disable data logging
💡 Good to know: OpenAI’s API (paid version) does not use your data to train models by default, but ChatGPT (free or Plus) does.
3. Design for data minimization & anonymization
Only send the minimum data your AI tool needs. You can:
Remove names, emails, or IDs before sending to an API
Use placeholders (e.g. "Client X")
Filter sensitive inputs before processing
Example:
Don’t send entire chat logs to your AI support assistant — summarize key intent and send that instead.
4. Inform users transparently
GDPR requires that users know:
When and how their data is used by AI
Which third-party providers are involved
What happens to their data afterward
You should:
Update your privacy policy with AI-specific sections
Include AI-related disclosures in onboarding
Offer opt-outs where feasible
